Do nothing and hope
You make a gift and do not cover yourself in any way. That might work out, but if you pass away within the legally defined “suspect period” (currently 5 years in Flanders and Wallonia, and 3 years in Brussels), your beneficiary may have to pay inheritance tax on the gifted amount.
The tax rate depends on your region and the relationship between you and the beneficiary:
For partners, children and grandchildren: from 3% for smaller amounts, up to 30% for larger ones
For more distant relatives: rates can go up to 80%
Register your gift with a notary
You can choose to register the gift immediately via a notary. In that case, gift tax is paid upfront, and no inheritance tax is due if you pass away within the suspect period.
Gift tax rates:
- 3% (or 3.3% in Wallonia) for partners, children, grandchildren, parents and grandparents
- 7% (or 5.5% in Wallonia) for other relatives
Take out a Donation Care term life insurance
With NN Donation Care, your beneficiary takes out a temporary life insurance policy on your behalf, for the estimated amount of inheritance tax linked to your gift. You are the insured person. If you pass away within the suspect period, the insured capital is paid to your beneficiary to cover the tax. The higher the amount of the gift, the more attractive a term life insurance is.
